OGRP is pleased to note the United States Court of Appeals for the Federal Circuit in Henny Penny Corporation vs. Frymaster LLC on September 12, 2019 upheld the United States Patent and Trademark Office Patent Trial and Appeal Board’s holding that Frymaster’s US Patent No. 8,497,691 covering a system of measuring the state of degradation of cooking oils in deep fryers using an external oil quality sensor is not unpatentable as obvious.  OGRP is glad that a patent which it drafted and prosecuted has been upheld, and further pleased to have joined with Kirkland & Ellis and Frymaster in defending this important patent. See attached decision from the CAFC.
