On March 24, 2015, David Aker, Of Counsel to the firm, participated in “A Modern Day Markman Hearing Concerning the Classic Wright Brothers Patent” in Utica, New York. The proceeding, conducted at the Hotel Utica, before United States District Court Chief Magistrate Judge David E. Peebles, was designed to provide attorneys with knowledge of the procedure used to determine the meaning of terms in a patent claim. Mr. Aker was invited to participate, in part due to his knowledge as a commercial pilot.

He acted as expert witness Samuel Pierpont Langley, a celebrated scientist of the time, and underwent direct examination based on questions and answers he wrote, and a rigorous cross examination. Mr. Aker is also an Adjunct Professor of Law, teaching patent law and related courses, and a co-author of Patent Law: A Practitioner’s Guide (4th Edition), published by the Practising Law Institute.
