The US PTO is now acting on its goal to incentivize accuracy in the US trademark registration records. Effective January 2, 2021, the USPTO implemented a fee for requests to delete goods, services, or classes from a registration during the examination of a maintenance filing or during an audit. The fee details are shown in the below Trademark Alert issued by the US PTO. Clearly the US PTO is targeting “deadwood” registrations and/or registrations not supported by use in order to clean up the register. Please contact us if you have any questions.
Post registration fees
New fee for deleting goods, services, and/or classes from a registration after submitting a section 8 or 71 declaration, but before the declaration is accepted: $250 per class if filed through TEAS. There is no fee if you electronically file a section 7 request to amend your registration before submitting a section 8 or 71 declaration and only delete goods, services, and/or classes in the request (otherwise, the current fee for filing a section 7 request through TEAS is $100).
